Agreement to Terms

These Terms & Conditions constitute a legally binding agreement between you ("you") and SoleMate, LLC ("Company", "we", "us", or "our"), regarding your access to and use of the https://solemateco.com website and related channels (the "Site"). By accessing the Site, you agree to be bound by these Terms & Conditions. If you do not agree, please discontinue use immediately.

Supplemental Terms

Additional terms or documents posted on the Site are incorporated herein by reference. We reserve the right to modify these Terms at any time, with changes effective upon posting. Continued use after changes constitutes acceptance.

Age Restriction

The Site is intended for users 18 years or older.

Intellectual Property

Unless otherwise indicated, all content and trademarks on the Site are owned or licensed by us and protected by U.S. and international laws. Content is for your personal use only and may not be exploited without our written consent.

User Representations

By using the Site, you represent that:

  • All registration information is accurate and current.
  • You have legal capacity and agree to these Terms.
  • You are not a minor in your jurisdiction.
  • Your use complies with all applicable laws.

User Registration

You may be required to register with the Site. You agree to keep your password confidential and will be responsible for all use of your account and password. We reserve the right to remove, reclaim, or change a username you select if we determine, in our sole discretion, that such username is inappropriate, obscene, or otherwise objectionable.

Products

We make every effort to display as accurately as possible the colors, features, specifications, and details of the products available on the Site. However, we do not guarantee that the colors, features, specifications, and details of the products will be accurate, complete, reliable, current, or free of other errors, and your electronic display may not accurately reflect the actual colors and details of the products. All products are subject to availability, and we cannot guarantee that items will be in stock. We reserve the right to discontinue any products at any time for any reason. Prices for all products are subject to change.

Product Warranty

All SoleMate machines include a 12-month limited warranty covering defects in materials and workmanship under normal use. The warranty period begins on the delivery date shown by the carrier's tracking confirmation. Warranty does not cover misuse, abuse, accident, modification, improper installation, or normal wear and tear. To the extent permitted by law, any implied warranties are limited in duration to the 12-month warranty period. See Returns, Refunds, Shipping Issues, and Warranty below for full details. International customers may be responsible for shipping costs for warranty claims.

Purchases and Payment

  • All prices are in U.S. dollars.
  • Accepted payment methods: Visa, Mastercard, American Express, Discover, Check, ACH Transfer, PayPal.
  • You agree to provide accurate purchase and account information and to update it as needed.
  • Sales tax is charged as required.
  • We may change prices at any time.
  • All payments must be made in U.S. dollars.
  • Orders are final and non-refundable. See Returns, Refunds, Shipping Issues, and Warranty below for full details.
  • We reserve the right to refuse, limit, or cancel any order at our discretion.

Returns, Refunds, Shipping Issues, and Warranty

All Sales Final (No Returns / No Refunds)

Because our products are commercial equipment, all orders are final, non-refundable, and non-exchangeable. We do not accept returns or exchanges, including for reasons of preference, dissatisfaction, or change of mind.

Shipping Damage or Wrong Item (14-Day Notice Requirement)

If your order arrives damaged in transit or you receive the wrong item, you must contact SoleMate, LLC within 14 days of delivery at contact@solemateco.com with your order number and clear photos of the packaging and item(s). If verified, we will, at our discretion, provide replacement parts or other support to correct the order. Refunds are not provided.

12-Month Limited Warranty (From Delivery Date)

All SoleMate machines include a 12-month limited warranty covering defects in materials and workmanship under normal use (the "Warranty Period"). The Warranty Period begins on the delivery date shown by the carrier's tracking confirmation. This warranty does not cover misuse, abuse, accident, modification, improper installation, or normal wear and tear. During the Warranty Period, SoleMate will, at its discretion, provide remote troubleshooting support and either (a) ship replacement parts, and/or (b) repair the machine. All warranty claims require troubleshooting and supporting photos/videos before any parts are shipped or any return is authorized. Warranty remedies are limited to repair and/or replacement parts and do not include returns or refunds.

To the extent permitted by law, any implied warranties, including merchantability and fitness for a particular purpose, are limited in duration to the 12-month Warranty Period. Some jurisdictions do not allow limitations on how long an implied warranty lasts, so the above limitation may not apply to you. This warranty gives you specific legal rights, and you may also have other rights which vary by state.

Warranty Shipping

For warranty claims approved within the Warranty Period, SoleMate will ship replacement parts by standard ground service within the United States at SoleMate's cost. For international orders, customers are responsible for shipping, duties, taxes, VAT, brokerage fees, and customs charges related to warranty parts or service. If SoleMate authorizes a return for repair (RMA), the customer is responsible for shipping the machine to SoleMate, and SoleMate will pay standard ground return shipping within the United States after warranty repair is completed.

Out of Warranty (Paid Repair)

After the Warranty Period ends, repair support is offered as a paid service. Customers are responsible for parts, labor, and all shipping costs. SoleMate will provide a quote for approval prior to performing paid repairs.

Refused Delivery / Undeliverable Shipments

If a shipment is refused, returned to sender, or undeliverable due to an incorrect address or recipient action or inaction, the customer is responsible for any resulting shipping, return shipping, storage, and re-delivery fees. The carrier's "delivered" tracking scan governs proof of delivery.

International Clients and Purchases

  • SoleMate, LLC welcomes international clients; however, all purchases are governed by the laws of the United States and the State of California.
  • All prices and payments must be made in U.S. dollars.
  • International buyers are solely responsible for compliance with local laws, import duties, taxes, VAT, brokerage fees, and customs requirements.
  • SoleMate, LLC is not liable for delays, losses, damages, or additional costs resulting from customs clearance, import regulations, or international shipping.
  • Warranty service for products shipped outside the U.S. may be limited. International customers may be required to pay shipping for warranty claims and replacement parts.
  • SoleMate, LLC reserves the right to refuse orders or restrict shipping to certain countries or regions at its discretion. If an order cannot be fulfilled to a destination, a full refund will be issued.
  • By ordering from outside the U.S., you agree to these terms and agree that any dispute will be resolved exclusively in the courts of San Diego County, California, USA.

Prohibited Activities

You may not use the Site for unlawful or prohibited purposes, including:

  • Data mining, scraping, or unauthorized data collection.
  • Impersonation or misuse of another's account.
  • Circumventing security features.
  • Competing with us or using the Site for commercial gain without consent.

Submissions

You acknowledge and agree that any questions, comments, suggestions, ideas, feedback, or other information regarding the Site ("Submissions") provided by you to us are non-confidential and shall become our sole property. We shall own exclusive rights, including all intellectual property rights, and shall be entitled to the unrestricted use and dissemination of these Submissions for any lawful purpose, commercial or otherwise, without acknowledgment or compensation to you.

Site Management

We reserve the right to monitor, restrict, or terminate Site access at our discretion.

Modifications & Interruptions

We may modify or discontinue the Site or any content at any time without notice. We are not liable for any resulting loss or inconvenience.

Disclaimer of Warranties

The Site and all products and services provided by SoleMate, LLC are offered on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose. We do not warrant that the Site, products, or services will be uninterrupted, error-free, or free of viruses or other harmful components.

Limitation of Liability

To the maximum extent permitted by law, SoleMate, LLC and its officers, employees, or agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your use or inability to use the Site or products; (b) any unauthorized access to or use of our servers and/or any personal information stored therein; or (c) any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, transmitted, or otherwise made available via the Site.

Indemnification

You agree to defend, indemnify, and hold harmless SoleMate, LLC, its affiliates, officers, agents, partners, and employees from and against any loss, damage, liability, claim, or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your use of the Site, violation of these Terms, or violation of any rights of others.
